Casey Anthony: Defense Asks For Reconsideration Of Sanctions

Casey Anthony’s defense team has filed a motion asking the judge to reconsider his order that sanctioned the defense and fined attorney Jose Baez more than $500.

From the Orlando Sentinel:

The 12-page motion also provides additional details about what defense expert witnesses will testify about during depositions and, presumably, at trial.

“The defense has, because of the intervening actions, provided the above information in an effort to, not only fulfill the requirements of the court, but also show a good faith effort in complying with this court’s directions,” Cheney Mason wrote.

The issue revolves around the prosecution’s – specifically Assistant State Attorney Jeff Ashton’s — request for sanctions against Baez. In December, Ashton complained that Baez had not turned over adequate expert witness discovery information in preparation for depositions.

The 2nd Paragraph of the above text really gets me.
Oh sure— “Because of the intervening actions”… they have NOW done what they were supposed to do before. The Defense knew what was required of them and had ample warning with regard to Time Limits. Their “complying” at this point and asking for Forgiveness— only after the Judge called their Bluff— is still a Slap in the Face to the Court’s requirements in the first place no matter how you look at it. Furthermore, due to their initial Neglect of those requirements, it is causing additional loss of Time to The Prosecution’s need for preparation, not to mention the Inconvenience of it all to everyone involved. If The Prosecution has no problem doing THEIR Job according to the Rules, The Defense has to do the same. I really hope Judge Perry makes the Fine stick.

If the judge removes the sanctions now it will only encourage Baez and cmopany to continuing their antics in the future on the assumption they’ll get away with it. Keeping those sanctions is the only way to make this nightmare team toe the line.

You are right Jon! And, with each infraction, the fines should double!!
