Casey Anthony: Motions…Denied

Judge Belvin Perry denied a series of defense motions today which concentrated mostly on constitutional arguments against the use of the death penalty.

From the Orlando Sentinel:

Perry denied eight motions — seven of them filed late last year and one filed this year.

The defense team’s motions questioned the constitutionality of certain elements of Florida’s death penalty statute, which calls for a weighing of aggravating and mitigating factors by a jury if a person is convicted of first-degree murder and then faces the death penalty.

Florida statute establishes an “aggravating circumstance” when a murder was especially “heinous, atrocious, or cruel.”

    Wonder why Baez didn’t have a problem with it when he took-up Lawyering years ago. What a Crock. The Defense’s Tail is again between their Legs.
