Apple Sued Over iPhone Issues

And now, on with the lawsuits….

An iPhone customer, Jessica Alena Smith, is suing Apple because of issues she is having with her phone’s reception. Smith is seeking a court order forcing Apple to repair or replace any parts that are not working as advertised plus she is also seeking unspecified monetary damages.

An Alabama woman has filed a lawsuit against Apple, claiming the iPhone 3G’s network is slower than advertised.

In a 10-page complaint filed Tuesday in the U.S. District Court for Northern Alabama, Birmingham resident Jessica Alena Smith charged Apple with breach of express and implied warranty and with unjust enrichment. Smith, who refers to the phone she purchased throughout the complaint as “Defective iPhone 3G,” is seeking class action status.

The lawsuit claims that Apple’s iPhone 3G advertising campaign is misleading.

A copy of the lawsuit is posted on Justia.com. In it, Smith notes that many other iPhone 3G users are reportedly having similar problems. The case deserves class-action status, she argues.

Some reports indicate that the iPhone’s problems are because of its Infineon chips or issues related to AT&T’s network, but those companies are not part of the suit.

Apple released multiple firmware updates for the phone, the most recent coming last weekend, which some customers said actually caused more problems. The company at first not did say what bugs the updates fix but finally confirmed 3G reception as one of the issues to the Associated Press.

I’m not a fan of the “sue happy” culture we live in and I for one, would not sue Apple over the issues which people are having. But, we do have the right to demand these issues be fixed and I am not opposed to that in one bit. To each his own. Thoughts?

    I would love to get information on this sue and add my self to it. I really think this is the best way. We have been cheated and misled. I have been a MAC user, loyal customer since 1986. I feel Apple totally screwed us up with a product and this time I do not want to put up with.

    Is it the iPhone, the crummy AT&T data network, or both? Personally, I blame AT&T. They have been sued over and over for deceptive advertising, and their latest bout of “more bars in more places” is incredibly deceptive, because if you read the small print it says “based on worldwide coverage”, but they don’t own anything outside of this country! And you can’t use it in these other countries unless you create your own relationship with a carrier there, and then do this over and over in every country. It is deceptive, and they know it. And their data claim of “our 3G network is twice as fast” sure as heck implies that they mean twice as fast as anyone else. Try HALF as fast as VZ or S. It is merely twice as fast as their anemic EDGE network. I ascribe over half of all of these problems to AT&T for promising the world, and delivering whatever they feel like.

    What did people expect? AT&T is the worst wireless carrier in the USA! People are finally waking up and realizing that Apple completely brain washed stupid people into buying a PDA that wasn’t all that good to begin with!

    That is what happens when you blindly follow trends! The company makes you think the iPhone and AT&T are the greatest thing ever! Then you wake up and your wallet is empty!

    Dah?! You don’t get money back from being stupid!! Next time follow your own trend, don’t let some company own you!!

    James Kelley, you should probably not comment on GSM when you have no clue about it, AT&t along with t mobile are the only carriers in this country that have phones that work on the system the whole world uses. VZ and sprint are old technology and offer no Global service unless you rent a GSM phone from another company. I travel in Europe and have never had to “establish a relationship” with any overseas carrier. Please dont take out a personal vendetta against a company with false statements.

    I would love to join suit with someone. My iphone is the only phone I have and I do business on it. I get dropped calls on a continual basis. It slowed for awhile and now it’s back up and at it. I think it’s at&t, but yes, it’s worth a suit. This is my business and livelihood.
